TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SIXEES LABS (PTY) LTD, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE WEBSITE OR ANY CONTENT ON IT, REGARDLESS OF THE THEORY OF LIABILITY.
OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE WEBSITE OR THESE TERMS SHALL NOT EXCEED ONE THOUSAND SOUTH AFRICAN RAND (ZAR 1,000).
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.

You agree to indemnify, defend, and hold harmless Sixees Labs (Pty) Ltd and its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:

12. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict-of-law principles.
Any dispute arising out of or relating to these Terms or your use of the Website shall be subject to the exclusive jurisdiction of the courts of the Republic of South Africa, save that Sixees Labs may bring proceedings in any other jurisdiction where necessary to protect its rights.
If you are a consumer in the European Union or United Kingdom, nothing in these Terms affects your statutory rights under applicable consumer-protection laws, and you may bring proceedings in the courts of your country of residence.
13. Changes to These Terms

14. General Provisions
14.1 Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Sixees Labs in relation to your use of the Website, and supersede any prior agreement or understanding between you and Sixees Labs in relation to the Website. They do not affect any separately signed agreement between you and Sixees Labs in relation to our products or services.
14.2 Severability
If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable, and the remaining provisions shall continue in full force and effect.
14.3 No Waiver
Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of that right or provision.
14.4 Assignment
You may not assign or transfer these Terms, or any of your rights or obligations under them, without our prior written consent. We may assign these Terms without restriction in connection with a merger, acquisition, corporate restructuring, or sale of assets.
14.5 Force Majeure
We shall not be liable for any failure or delay in performance under these Terms due to circumstances beyond our reasonable control, including acts of God, natural disasters, fire, flood, war, terrorism, pandemics, civil unrest, government actions, utility outages, internet outages, or failures of third-party services.
14.6 No Agency
Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and Sixees Labs.
14.7 Survival
Sections that by their nature should survive termination or expiry of these Terms — including Sections 4.3 (Feedback), 5 (Intellectual Property), 9 (Disclaimer of Warranties), 10 (Limitation of Liability), 11 (Indemnification), 12 (Governing Law and Jurisdiction), and this Section 14 — shall so survive.
